If you are involved in a car crash, you don’t have to give any information that may be used to incriminate you in a criminal investigation (such as a DUI or Vehicular Manslaughter charge). You should exit your vehicle and remain OUTSIDE of the vehicle until you have fulfilled your obligations under Florida law. Florida law requires that a person involved in a crash resulting in injury or death to a person, or damage to an occupied vehicle, only needs to provide their name, address, and registration number of the vehicle. This is easily accomplished by producing your Driver’s License and Vehicle Registration. If it is apparent that a person needs medical assistance, or requests such, it is required that you render reasonable assistance, such as calling 911 for emergency assistance.

Do not give more information than is required by law. Anything you say WILL be used against you. In order for the government to prove a DUI, Leaving the Scene of an Accident, Driving While License Suspended, or Vehicular Manslaughter charge, they must first establish that you were driving or in actual physical control of a motor vehicle. If you are not in the car, and no one else can put you behind the wheel, then they’ll need you to tell them what happened in order to make a case against you. Any explanation of the events that led up to the crash, even if you think you are convincing the cop that you aren’t at fault for the crash, will at least put you behind the wheel and help them make the case against you. YOU SHOULD NOT LIE. JUST DON’T TALK. Make them do the work and make the case against you…if they can.
