DUI Charges Dropped – 5/13/2016
Client was stopped for a headlight being out and for an expired registration. The Officer claimed that the client was giving incoherent responses to questions, and noted an odor of alcohol, red eyes and unsteady balance. A DUI officer was called in to investigate and the client performed field sobriety exercises on video. The client was then arrested and had a breath test result of .177.
Result: Client was offered Pre-Trial Diversion, which would have guaranteed a dismissal of the DUI. Instead, the client accepted a plea to a reckless driving (as it involved less cost/penalties than a diversion program) and the DUI charge was dropped.
