You want to know how much jail time you will actually serve on a particular sentence, but there seems to be no clear answer. The reason is because there is no clear answer. Florida prisons are legally permitted to subtract time from a sentence of fifteen percent under most circumstances. Florida Statute 944.275 mandates that and all prisoners must serve at least eighty-five percent of their sentences. For example, if a defendant is sentenced to 5 years prison (60 months) they could be released after serving only 51 months, or eighty-five percent of the sentence. After two strikes, you’re out! - [Stand-Your-Ground and the Castle Doctrine](https://www.longwelllawyers.com/stand-your-ground-and-the-castle-doctrine/): Ever since the shooting death of Trayvon Martin by George Zimmerman, a volunteer neighborhood watchperson, everyone is talking about the Castle Doctrine and the Stand-your-Ground laws in Florida. Many people are finding out that they don’t understand what these two laws are and how they are applied. The reason they can be confusing is because they are very similar rules of law. The Castle Doctrine is based out of common law stating that a person does not have a duty to withdraw from their home, or their “castle” as it is referred to, and may use reasonable force, as well as deadly force, to defend their place, their selves, or other people. Basically stated, you have a right to attack and defend yourself for an intruder instead of leaving your home. In Florida the law has been extended and your “castle” can be any place legally occupied. It does not need to have a roof on it. It can be movable or stationary, or it could even be as temporary as a tent. Under the Castle Doctrine, if you are beyond your “castle” and you have the ability to do so, you have a duty to retreat before using force. (Dorsey v. State, 74 So.3d 521 (2011)) Deadly force is considered justified force only in cases when you reasonably feared immediate death or serious bodily harm to yourself or another. Besides Florida, forty-six states have integrated a version the Castle Doctrine into their laws. - [5TH Amendment Rights – They Are That Important!](https://www.longwelllawyers.com/5th-amendment-rights-they-are-that-important/): I currently represent a client who is facing a very long stretch in jail. Had he simply stated these rights, he would not be looking at many years in prison. Had he invoked his rights, The State of Florida would have no evidence to use against him. Not consenting to a search or by not answering any questions may be the difference in whether the State can charge you with a crime. Whether the State tries to put you in jail, or whether you become a convicted criminal. You don’t have to remember your 5th Amendment Rights, but at the very least, remember to not say or do anything without talking to an experienced Orlando criminal attorney first! - [Early Termination of Probation](https://www.longwelllawyers.com/early-termination-of-probation/): If the probationer has performed satisfactorily, has not been found in violation of any terms or conditions of supervision, and has met all financial sanctions imposed by the court, including, but not limited to, fines, court costs, and restitution, the Department of Corrections may recommend early termination of probation to the court at any time before the scheduled termination date. - [Mediation and Marital Settlement Agreements Are Contracts in Florida](https://www.longwelllawyers.com/mediation-and-marital-settlement-agreements-are-contracts-in-florida/): While it is often thought that a Judge determines the terms of a divorce or paternity action, the reality is that, in a majority of cases in Florida, the parties are able to negotiate and settle their case without the necessity of going to trial. The contract that contains all the terms of a divorce is called the “Marital Settlement Agreement” or it may be referred to as the “Mediated Settlement Agreement.” A copy of this agreement is incorporated into a Final Judgment and creates a legally enforceable obligation between the parties in a case. - [Waiver of Impound Requirement After Dui Conviction](https://www.longwelllawyers.com/waiver-of-impound-requirement-after-dui-conviction/): Florida Statute Section 316.193(6)(a) states that a court may order a ten (10) day impoundment or immobilization of the vehicle the defendant was driving ,or in actual physical control of, when he/she was arrested for DUI or any other vehicle registered under the defendant’s name. The impoundment or immobilization of the vehicle should not run concurrent with the defendant’s prison sentence. Therefore, a defendant needs to wait until he/she has served their entire jail sentence before taking steps to impound or immobilize their vehicle. This does not mean you need to tow away your vehicle; there are less expensive ways to fulfill this requirement, such as booting your car. - [How to Get a Writ of Garnishment?](https://www.longwelllawyers.com/how-to-get-a-writ-of-garnishment/): Chapter 77 of Florida Statute (2012), states that any person or entity that has sued to recover a debt or has obtained a judgment in any court against any person or entity has a right to a writ of garnishment. This is a handy instrument when you have sued and won, but the defendant refuses to pay you the amount ordered in the final judgment. With a writ of garnishment the plaintiff can recover their debt through any debt due to the defendant by a third person, for example: salary or wages owed by an employer, rental income, and bank accounts (checking, saving, trust accounts). - [What Is Entrapment?](https://www.longwelllawyers.com/what-is-entrapment/): Entrapment is a defense to a crime, such as trafficking. There are two different types of entrapment in the State of Florida: subjective and objective. Subjective entrapment is codified in Section 777.201, Florida Statutes (2012), and focuses on inducement of the defendant by an agent of the government when the defendant did not have a predisposition to commit the crime. Objective entrapment arises in the presence of egregious law enforcement conduct and is to be objectively evaluated under the Due Process Clause of Article I, Section 9, of the Florida Constitution . Munoz v. State, 629 So.2d 90, 99 (Fla.1993). - [What Is “Speedy Trial” in Florida?](https://www.longwelllawyers.com/what-is-speedy-trial-in-florida/): When a person is arrested or charged with a crime, the law requires that the person is given a trial within a reasonable period of time. This is known as the right to a speedy trial. This is a fundamental constitutional right that is codified in Florida law. If not for this important right, the government could arrest or charge someone on flimsy facts, but still hold the person in jail while indefinitely delaying the requirement of proving the charge beyond a reasonable doubt at trial. The effect would be to allow the government to leave charged individuals to languish, while the government is under no time constraint to act. - [What Is a Parenting Plan?](https://www.longwelllawyers.com/what-is-a-parenting-plan/): If you are going through a divorce in Florida and you have one or more minor children with your spouse, you must create a parenting plan and have it approved by the court before the divorce is finalized. A parenting plan is a document developed and agreed to by the parents of a minor child. When I speak to people who are contemplating filing for divorce, there is one question that is always asked: How long does it take to get divorced? - [Divorce – Term of the Day](https://www.longwelllawyers.com/divorce-term-of-the-day/): the termination of a marriage by legal action, requiring a petition or complaint for divorce (or dissolution in some states, including California) by one party. Some states still require at least a minimal showing of fault, but no-fault divorce is now the rule in which “incompatibility” is sufficient to grant a divorce. The substantive issues in divorces are division of property, child custody and support, alimony (spousal support), child visitation and attorney’s fees. Only state courts have jurisdiction over divorces, so the petitioning or complaining party can only file in the state in which he/she is and has been a resident for a period of time (as little as six weeks in Nevada).
