Florida Statute § 948.04(3), states the following:

If the probationer has performed satisfactorily, has not been found in violation of any terms or conditions of supervision, and has met all financial sanctions imposed by the court, including, but not limited to, fines, court costs, and restitution, the Department of Corrections may recommend early termination of probation to the court at any time before the scheduled termination date.

This statute allows an individual to request the court for early termination of probation when at least fifty percent (50%) of their probationary period has been completed together with all special conditions of probation, such as, but not limited to, counseling, courses, community hours, and all financial sanctions. If you believe you qualify for early termination of probation you can hire an attorney to file a petition with the court for early termination and schedule a hearing to prove to the judge that you qualify under Florida Statute § 948.04(3). However, it is within the judge’s discretion to grant or deny early termination of probation, and something they take into account is whether you can prove that you completed all special conditions of probation, and if you have ever violated your probation (i.e. tested positive on a random drug test).

You should consider filing for early termination of probation as soon as you are eligible because it removes the possibility of violating your probation in the future. Violating probation is a new criminal charge that can get you arrested and stuck in jail without a bond. Additionally, filing for early termination of probation removes the inconvenient requirements related with having probations, such as restrictions on traveling, expenses, difficulty finding employment, reporting periodically, and random drug testing.

If the judge grants your petition for early termination of probation, you should also consider, if you qualify, sealing or expunging your record.
